1. Terms

By accessing this Website, accessible from wisehosting.com, you are agreeing to be bound by these Website Terms and Conditions of Use and agree that you are responsible for the agreement with any applicable local laws. If you disagree with any of these terms, you are prohibited from accessing this site. The materials contained in this Website are protected by copyright and trade mark law.

2. Use License

Permission is granted to temporarily download one copy of the materials on WiseHosting Ltd's Website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose or for any public display;
• attempt to reverse engineer any software contained on WiseHosting Ltd's Website;
• remove any copyright or other proprietary notations from the materials; or
• transferring the materials to another person or "mirror" the materials on any other server.

This will let WiseHosting Ltd to terminate upon violations of any of these restrictions. Upon termination, your viewing right will also be terminated and you should destroy any downloaded materials in your possession whether it is printed or electronic format.

4. Limitations

WiseHosting Ltd or its suppliers will not be hold accountable for any damages that will arise with the use or inability to use the materials on WiseHosting Ltd's Website, even if WiseHosting Ltd or an authorize representative of this Website has been notified, orally or written, of the possibility of such damage. Some jurisdiction does not allow limitations on implied warranties or limitations of liability for incidental damages, these limitations may not apply to you.

WiseHosting Ltd will not promise that any of the materials in this Website are accurate, complete, or current. WiseHosting Ltd may revise these Terms of Use for its Website at any time without prior notice. By using this Website, you are agreeing to be bound by the current version of these Terms and Conditions of Use.

9. Payments

Customer acknowledges that the Company is under no obligation to provide services under the terms of this Agreement until all stated charges have been paid-in-full, and Company has been able to adequately verify the validity of said payment. Recurring payments will become due and payable on the first day of the month following the completion of the first invoice term, and will continue as such for all subsequent invoices. Any account that becomes past-due may be suspended or disabled for non-payment at any time at the sole discretion of the Company.

9.1 Refund Policy

All services rendered by the Company are provided on a non-refundable basis and stated as Final. This includes, but is not limited to, setup fees, monthly fees, upgrade fees, professional services fees, and bandwidth overage fees, regardless of usage. In addition, if your account is canceled by the company for violation of this Agreement, all payments made to the Company become completely non refundable. Customer agrees not to charge back any credit card payments for services rendered. In the event that a customer files a charge back or other payment dispute, they will be considered to be in violation of this agreement and may be subject to collection action.

9.2 Billing Errors

Customer acknowledges that the Company will make its best effort to ensure that all invoices are correctly issued. However, should Customer note any possible errors, Customer agrees to notify our Billing department within 15 days of the issuance of the errant invoice. After 15 days, all invoices will be assumed to be correct, and no further billing adjustments will be made. Failure to cancel a service before its renewal date does not constitute a billing error.

9.3 Credit Card & PayPal Payments

Where available, the Customer authorizes the Company to automatically debit any credit/debit card(s) and PayPal accounts placed on file with the Company during the ordering process or via subsequent account updates on the due date of each invoice. Should the Customer's credit card be declined for any reason, Company will contact customer to notify them of the declined charge, and will continue to resubmit the credit card on file for payment until the balance is paid in full. If the Company is not able to charge the Customer's credit card as noted above for the full amount due, Customer authorizes the Company to split the total amount due across multiple debit transactions to the credit card(s) on file equaling the total amount due. An invoice will be issued to the Customer's registered email prior to each renewal charge. Non-receipt of such invoice does not relieve the Customer of payment obligations or entitle the Customer to a refund.

9.4 Service Cancellation

Services may be cancelled at any time through the WiseHosting billing panel. Cancellations take effect at the end of the current billing period. No prorated or partial refunds will be issued for unused time.

9.5 Renewal Goodwill Refund

If an automatic renewal is processed and the Customer did not intend to continue the service, the Customer may request a refund within 24 hours of the renewal charge by contacting us via a support ticket or email. After 24 hours, renewal payments are final. This does not apply to accounts terminated for violation of this Agreement.

10. Money-Back Guarantee

10.1 Eligibility

New customers may request a full refund within 7 days of their initial purchase by submitting a support ticket or email. Upon request, the Customer will be required to complete a short feedback form provided by WiseHosting. Failure to complete the form or respond to any communication within 48 hours will void the refund request. This guarantee applies once per customer, to new purchases only — renewals, upgrades, and subsequent orders are not eligible. Cancelling a service through the billing panel does not constitute a refund request.

10.2 Limitations

This guarantee is limited to one refund per individual, regardless of the number of accounts created. Customers who have previously held a WiseHosting account are not eligible. WiseHosting reserves the right to decline a refund request if signs of fraud or abuse are detected.

10.3 Refund Processing

Upon approval of a refund, the associated service will be immediately terminated and all data permanently deleted. Refunds are issued to the original payment method. Where the original payment method does not support refunds, a refund to WiseHosting account credit may be offered at the Company's discretion.

10.4 Chargebacks and Disputes

Customers who initiate a chargeback or payment dispute forfeit eligibility for this guarantee. Any chargeback or dispute will result in immediate termination of all associated services with no option for reinstatement.

10.5 Exclusions

This guarantee does not apply to accounts terminated for violation of this Agreement or the Service Usage Policies.

11. Affiliate Terms and Conditions

11.1 Commission Structure

Affiliates earn a recurring commission rate of 10% on all new orders made by referred clients, unless otherwise agreed upon. Commissions are calculated based on successful transactions only.

11.2 Withdrawal Options

Withdrawals can be made either to your WiseHosting credit balance, which will receive a 10% bonus, or through PayPal, which are subject to a 10% withdrawal fee.

11.3 Commission Maturation Period

All commissions earned are subject to a 35-day maturation period. If the referred service is refunded, canceled, or terminated during this period, the commission will be void and will not be credited to your affiliate account.

11.4 Affiliate Guidelines

Affiliates are prohibited from advertising their affiliate links through paid advertising platforms or services (e.g., Google Ads).

When promoting your affiliate link, you must adhere to the terms of service of the website or platform where you advertise.

Your affiliate link must remain visible and cannot be hidden behind another link, button, or image.

Affiliate links may not be displayed on websites that promote coupons or discounts.

You may not click on your own affiliate link or earn commissions for self-referrals. No commissions will be paid for signups by yourself, members of your household, or individuals within your organization.

Any attempts to exploit or manipulate the affiliate system are strictly prohibited.

11.5 Compliance and Enforcement

Non-compliance with any provision in these terms may result in loss of eligibility to withdraw your affiliate balance, nullification of your affiliate account balance, suspension and/or termination of your account.

12. Service Usage Policies

12.1 Storage

Unlimited storage is provided under Fair Use, intended only for files directly related to your Minecraft server and within normal usage limits.

Any unrelated or excessive data may be removed, and WiseHosting will contact you if any action is taken or additional clarification is required.

12.2 Backups

Backups must be limited to data from your Minecraft server. Creating nested backups or storing unrelated files is not allowed.

If backup sizes go above Fair Use, WiseHosting will contact you for additional clarification and may limit backup slots or restrict new backups.

12.3 CPU Usage

CPU resources are intended for normal Minecraft server operation. Excessive or sustained load is not permitted.

If usage becomes disruptive to server stability, WiseHosting will contact you for additional clarification and may take action to limit the CPU usage.

12.4 Illegal Content (EU 2021/784)

You may not use WiseHosting to host or distribute terrorist content as defined under Regulation (EU) 2021/784.

WiseHosting may remove such content, disable access, or suspend services as required. Valid removal orders from competent authorities are handled with priority.

13. Governing Law

Any claim related to WiseHosting Ltd's Website shall be governed by the laws of Estonia (EE) without regards to its conflict of law provisions.
